Fiberwave Residential Uptime Agreement
This Uptime Agreement ("Agreement") governs the provision of Fiberwave Internet and Phone Services ("Services") provided by Fiberwave LLC, located at 748 W Hertitage Park Blvd #201, Layton, Utah 84041, United States (collectively referred to as "Fiberwave"). This Agreement is incorporated into the Fiberwave Residential Terms of Service. By using the Services, you agree to the terms outlined in this Agreement.
No Uptime Guarantee
Fiberwave does not guarantee or warrant that the Services will be uninterrupted, error-free, or available at all times. The Services may be subject to outages, interruptions, or degradation due to various factors, including but not limited to maintenance, technical issues, network congestion, or external events beyond Fiberwave’s control. Fiberwave strives to provide reliable Services but makes no representations or warranties regarding the availability or performance of the Services.
No Refunds for Service Interruptions
In the event of any Service interruption, outage, or degradation, whether planned or unplanned, Fiberwave will not provide refunds, credits, or any other form of compensation for any fees paid or owed for the Services. This includes, but is not limited to, monthly service fees, installation fees, or equipment fees outlined in the Fiberwave Fee Schedule.
Customer Responsibilities
You acknowledge and agree that Fiberwave is not liable for any damages, losses, or inconveniences resulting from Service interruptions or unavailability. You are responsible for maintaining alternative means of communication or internet access, if necessary, during any Service disruptions.
Changes to Agreement
Fiberwave may modify this Agreement at its discretion. Changes will not apply retroactively and will take effect no sooner than fourteen (14) days after posting, except for changes addressing new Service functions or legal requirements, which may take effect immediately. If you do not agree to the modified Agreement, you may discontinue using the Services and contact Fiberwave to terminate your account.
